1. Acceptance of the Terms
By creating an account, accessing, or using Motorista Positivo, the user acknowledges having read and agreed to these Terms and the Privacy Policy applicable to the service.
If the user does not agree to these Terms, they should not use the app.
2. Motorista Positivo
Motorista Positivo is an organization and tracking tool for drivers. Depending on available features, the app allows users to record income and expenses, track trips and mileage, organize vehicle and maintenance information, set goals, view indicators, challenges and achievements, and use supporting features such as voice entries and Copilot.
3. Account, registration, and security
To use account-linked features, users must provide accurate information and keep their data up to date. Registration may include name, date of birth, phone number, email, and access credentials, or Google Account authentication when available.
Users are responsible for protecting their credentials and for activity performed through their account. Improper sharing of credentials may compromise data security.
Motorista Positivo may use reasonable checks to protect accounts, subscriptions, and the free trial against fraud or abuse.
4. Free trial
Eligible accounts may receive 10 days of free use, counted according to the benefit record in Motorista Positivo's systems. The free period is intended for service evaluation and may be granted once per account or according to eligibility criteria shown in the app.
Reinstalling the app or signing in again to the same account does not restart a free period that has already begun.
At the end of the free period, features requiring a subscription may be limited or blocked as indicated in the app, without automatically deleting the account's existing history.
5. Subscription, billing, and cancellation
Paid plans available in the app may include monthly, six-month, and annual options. Prices, taxes, currency, duration, any applicable discount, and other conditions are shown during checkout before confirmation.
On Android, subscription purchase, billing, and renewal are processed by Google Play. Motorista Positivo receives information necessary to validate access rights but does not store full card details or other complete payment-method information used on Google Play.
When automatic renewal is active, the subscription may renew according to the conditions displayed by Google Play. Users can manage or cancel renewal in Google Play subscription settings.
Canceling renewal does not necessarily cause immediate loss of access: paid access may remain available until the end of the period already purchased, according to the status reported by Google Play.
Refunds, where applicable, follow the rules and procedures of the store responsible for the transaction and applicable law.
6. Data entered by the user
Results displayed by the app depend on information recorded by the user and, where applicable, data obtained from device features authorized by the user. Incomplete, incorrect, or outdated information may produce balances, averages, goals, and indicators that differ from reality.
Users remain responsible for reviewing their records and deciding what information to use in their personal and professional organization.
7. Calculations, earnings per distance, and indicators
Values such as balance, profit, cost, averages, profit per distance, profit per hour, goals, score, and ideal earnings per distance are calculated from data available in the app and the rules of the corresponding feature.
These results are estimates and supporting indicators. They do not guarantee income, profit, savings, performance, or future results and do not replace professional accounting, financial, tax, or legal advice when necessary.
Users are responsible for decisions made based on this information.
8. Trips, mileage, and GPS
When users choose GPS tracking, distance and route accuracy may vary due to the device, permissions, signal quality, battery-saving settings, availability of location services, environmental conditions, and operating-system behavior.
Users should review trip data when accuracy is important and may use the manual features available in the app when necessary.
9. Copilot and voice entries
Copilot is an auxiliary feature designed to make information easier to view and rides easier to record. Values entered by typing or voice should be reviewed by the user before or after recording, according to the flow shown in the app.
Voice recognition may incorrectly interpret words or numbers due to noise, pronunciation, language, service availability, or device conditions.
Motorista Positivo does not control Uber, 99, inDrive, or other third-party platforms and does not guarantee the availability, prices, or conditions offered by those services.
10. Proper use
Users agree not to use Motorista Positivo for fraud, attempts to circumvent subscriptions or the free trial, unauthorized access to accounts or systems, infringement of third-party rights, or any unlawful purpose.
The app must be used in a manner consistent with road safety. Users should not handle the device unsafely while driving and must comply with applicable traffic laws and rules.
11. Availability and technical changes
We seek to keep the service available and functional, but we do not guarantee uninterrupted or error-free operation. Updates, maintenance, internet outages, Google services, device features, or other external factors may temporarily affect certain functions.
Features may be adjusted, improved, replaced, or discontinued when necessary for evolution, security, compatibility, or compliance with applicable obligations.
12. Intellectual property
The Motorista Positivo brand, visual identity, interface, text, software, proprietary logic, graphic elements, and other service content are protected by applicable law, except for third-party components and services subject to their respective licenses.
Use of the app does not transfer ownership rights in these elements to the user.
13. Account and data deletion
Users may request permanent deletion of their account and associated data directly through the app. After signing in, go to the profile and settings area, choose “Delete account”, and confirm the steps shown.
If the user cannot access the app, deletion may also be requested through the official contact channel shown on this page. To protect data, sufficient information may be requested to confirm that the request was made by the account holder.
Data that is deleted
When deletion is completed, data linked to the account and used to provide the service is removed, where present, including registration data such as name, email, phone number, and date of birth; income, expenses, and transactions; goals, challenges, and achievements; vehicle and maintenance data; preferences and other usage data stored specifically for the account; as well as the authentication account used to access Motorista Positivo.
Data that may be retained
Minimal records may be retained when necessary for security, fraud prevention, compliance with legal obligations, or protection against abuse of the free trial. These records are not used to continue providing the deleted account's service.
Google Play subscription
Deleting a Motorista Positivo account does not replace cancellation of an active Google Play subscription. If a subscription exists, the user should also open Google Play → Payments & subscriptions → Subscriptions to review or cancel renewal when necessary.
Requests made directly through the in-app deletion feature are processed by the system after user confirmation. Requests submitted through the contact channel will be reviewed and processed within a reasonable period, subject to legal obligations or identity-verification needs.
Access may also be restricted in cases of fraud, abuse, violation of these Terms, security risk, or when necessary to comply with a legal obligation, subject to applicable user rights.
14. Changes to these Terms
These Terms may be updated to reflect changes to the app, plans, legal requirements, or operational practices. The date of the current version will be shown on this page. When a change requires renewed consent, the app may request confirmation again.
15. Applicable law
These Terms are interpreted in accordance with the law applicable to the service and the user. Nothing in these Terms is intended to exclude or limit rights that cannot lawfully be excluded or limited, including consumer-protection rights where applicable.
